GENERAL CONDITIONS OF SALE

General Terms and Conditions of Sale and Special Conditions

The general terms and conditions of sale and the special conditions form an integral part of the sales contract, and their overall acceptance is mandatory before any sale can be concluded.

Making a reservation implies acceptance of these sales conditions and full, unconditional acceptance of their provisions.

1 - Rental:

The duration of the stay is set in advance and can only be modified with the agreement of KONOKORA ECOLODGE.

Cabin No. 01 (Anshi): Accommodation is provided for 2 people with a minimum age of 12 to access. A tolerance of two visitors is allowed from 9:00 a.m. to 7:00 p.m.

The rental price includes:

- The rental of your cabin between 3:00 p.m. and 11:00 a.m. the next day
- Reservation fees
- Bed linen and towels
- Private use of the pool
- Reasonable water and electricity consumption
- VAT in accordance with current legislation
- Garbage collection in a trash bag in the cabin.

1-1 - Hygiene:

The accommodation is made available to you in perfect usable and clean condition.

You will therefore be asked to return the accommodation in the same initial clean condition (clean dishes, discarded food, closed trash) under penalty of a cleaning fee of €20.

2 - Reservation:

The reservation becomes effective after online payment. Please check your SPAM for the reservation confirmation.

3 - Cancellation:

Our establishment does not offer any refund in case of cancellation or modification on your part:

- More than 15 days before your reservation date, a date postponement or a credit will be offered.
- Less than 15 days before your reservation date, the full stay will be due except in case of "Force Majeure."
- In case of "Force Majeure," a stay postponement will be offered or a credit of the amounts paid will be offered.

*Only one postponement allowed **Credit valid for one year

Please note that if the postponement is made to a date or period with a higher rate than the amounts paid, the difference will be due.

To cancel a reservation, the client is invited to contact KONOKORA ECOLODGE directly by email at konokora@gmail.com. The reservation cancellation is effective upon receipt of an email from KONOKORA ECOLODGE confirming the cancellation.

**3-1 - Modification or cancellation by KONOKORA ECOLODGE:**

1. In case of announced external events beyond our control (see 3-2-Force Majeure), we may have to modify or cancel your stay for safety reasons. We will then offer you a postponement of your stay to a later date within the following 12 months or a credit for a period of one year. If applicable, a refund will be offered.
2. In case of non-compliance with the reservation rules by the client (number of persons per cabin, presence of children under 12 years old), the establishment reserves the right to cancel the reservation. The refund of the amounts paid will be offered minus a fixed amount of €60 for administrative fees.
3. In case of non-compliance with the reservation rules by the client (number of persons per cabin, presence of children under 12 years old) observed on the day of the client's arrival, the establishment reserves the right to cancel the reservation. No refund or postponement will be offered.

3-2 - Force Majeure: Force majeure is understood as any external event beyond the parties' control that is both unforeseeable and insurmountable, preventing either the client or KONOKORA ECOLODGE from fulfilling all or part of the contractual obligations.

This includes, but is not limited to, cyclones, tropical storms, strikes, insurrection, riots, prohibitions issued by government or public authorities, restrictions related to COVID-19.

It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the costs arising from it.

Clients will notably bear alone any additional costs that may be incurred to enable the continuation of the journey following the occurrence of a force majeure event.

4 - Rates:

Our rates are subject to change based on economic conditions or regulatory provisions. They are inclusive of all taxes (excluding tourist tax). Only the price appearing on your invoice is valid.

Important: If, for any reason, there is a rate difference between the scheduled stay date and the postponed date, you will have to pay the difference.

4-1 - Gift Voucher: Gift vouchers are valid for one year. The validity date can be extended by 3 months for a fixed sum of €60. Gift vouchers are neither refundable nor exchangeable. Any modification or cancellation of the stay date less than 30 days will result in the loss of the validity of the gift voucher.

Please note your gift voucher is usable all year round except during the end-of-year holiday season. In case of use during this period, the rate difference will be payable.

5 - Arrival:

The accommodation is available from 4:00 p.m. to 6:00 p.m. Any delay must be announced by phone at 0690 45 17 98 or by email at konokora@gmail.com. Otherwise, the accommodation becomes available 24 hours after the scheduled arrival date.

In case of no-show by the client, all amounts paid remain acquired by the establishment.

6-visitors: As a reminder, the accommodation is intended for two people, however two visitors will be authorized from 9:00 a.m. to 7:00 p.m. In addition, parties and events of any kind are not authorized for the tranquility of the place.

7-Deposit: A deposit of €150 will be requested which will be returned to you after the inventory. In the event of damage caused in the home or on the property, property, furniture, objects or others, it will not be returned. An inventory of your accommodation is carried out before your arrival with repairs if necessary. Any embarrassing or damaged details must be reported upon installation, by any means available to you (photo, message, etc.).
Our establishment is strictly reserved for our guests and is prohibited to anyone who has not been presented to reception beforehand.

8- Accepted means of payment: Credit card, cash, bank transfer and holiday vouchers in exceptional circumstances.

9- Proof agreement: Emails will be authentic between the parties, particularly as to the nature and date of reservation.
Electronic communications are considered by KONOKORA ECOLODGE and by the client to have the probative value equivalent to those of written documents.
Our computer records, kept under reasonable security conditions, will provide proof of communications, reservations and payments made.

10- General Data Protection Regulations:
The customer is informed that the personal information communicated to KONOKORA ECOLODGE is subject to computerized processing, unless expressly opposed by him. The customer has a right of access, rectification or deletion at any time from KONOKORA ECOLODGE.
The information requested from you when booking is essential for the proper processing of your request. The only recipients of this information are KONOKORA ECOLODGE concerned by the reservation request. The customer's personal data will be held in accordance with our privacy policy.
In accordance with current legislation, electronic contracts are subject to electronic archiving for a period of 10 years for any contract worth more than €120.
The customer has a right of access to this data from KONOKORA ECOLODGE.
Our establishment undertakes not to sell, share or disclose your personal data
registered to third parties.

11 – Applicable law
Any dispute, any claim or any dispute relating to the terms of reservation of a stay or accommodation are subject to French law. ​

12- Safety instructions
It is strictly forbidden to jump on the house net, to jostle, to climb trees or on the roof of the cabin and to climb over the barriers. We decline all responsibility in the event of an accident.

Smoking is prohibited in the cabin. Smokers may, however, smoke on the terrace and must use the ashtray provided for this purpose. It is strictly forbidden to throw away cigarette butts outside the ashtrays provided for this purpose. The use of candles is strictly prohibited. Drug use is strictly prohibited. Alcohol should be consumed in moderation. It is strictly forbidden to throw anything from the top of the cabins or along the route. The cabin being a place of calm and rest, it is forbidden to shout, scream and speak too loudly, particularly during access to the cabins. Likewise, night trips must be done in the greatest calm. It is prohibited to behave violently and likely to provoke altercations. It is forbidden to bring people into the cabin other than those who have reserved the stay (for obvious security and insurance reasons. Failure to comply with one of these instructions will result in non-refund of the deposit and will result in the termination of the rental contract by the customer, and KONOKORA ECOLODGE will put an end to the rental, no compensation or reimbursement can be requested.

13-Children: The cabins cannot accommodate children under the age of 12 for safety reasons. A child over 12 years old remains under the full responsibility of the accompanying adult.

14- Special conditions: KONOKORA ECOLODGE offers atypical cabins (sometimes duplex) with private swimming pool under the sole responsibility of its occupants.

​

15- Animals: Our pets are not allowed in our accommodation and the park.

​

16- Complaints: Any complaint relating to the stay must be sent by registered letter with return receipt within 30 days following the stay to the following address: KONOKORA ECOLODGE

17- Personal effects brought by the customer: The customer is responsible for any valuable personal items in his possession. A safe will be provided to him which he will have access to during his stay. The key to said safe will be given to him upon his arrival and must be returned to KONOKORA ECOLODGE when the accommodation is vacated.

18- Civil liability: The customer must hold civil liability insurance.

19- Responsibilities: KONOKORA ECOLODGE declines all responsibility in the event of loss or theft of the customer's personal effects. Likewise, KONOKORA ECOLODGE declines all responsibility in the event of damage or theft from vehicles left in the parking lot.

21- Dispute: In the event of a dispute, only the jurisdiction of the Pointe à Pitre Court is recognized. In the event of a disagreement regarding the interpretation or execution of the clauses of these general conditions, the parties will endeavor to resolve their dispute amicably.

The accommodation offered being surrounded by nature and in the forest, the client will have to live the time of his stay with the other inhabitants of the forest, the animals and the insects… it is also possible at certain times of the year to find leaves, twigs or even dust (pollen, fine seeds, forest tree residue, etc.) in the open parts of the home.

The estate being in a semi-urbanized area but also in the forest, certain natural or urban noise “nuisances” may occur, the customer is asked to show understanding.

By reading these general conditions of sale, you agree to respect the safety rules as well as the general rental conditions and to ensure that those around you respect them. Any accident due to non-compliance with these rules cannot be blamed on KONOKORA Ecolodge or the municipality and will be your responsibility.
